نظام الرخص كآلية للتداول المستدام للنفايات الخطرة في الجزائر Licensing System As A Mechanism For The Sustainable Circulation Of Hazardous Waste In Algeria.

Résumé: يعتبر نظام الرخص، بمثابة أحد التدابير القانونية والوقائية الذي تتخذه الإدارة المكلفة بحماية البيئة، بغرض ضمان الرقابة المسبقة على كيفية تداول وإدارة النفايات الخطرة بدءا من مصدر إنتاجها إلى غاية التخلص منها بطرق سليمة بيئيا، ونظرا لطبيعتها وبفعل مكوناتها المحتوية على المواد السامة والخطرة، حيث تتطلب الحذر الدائم والمستمر عند التداول، هذا ما جعل المشرع الجزائري يكرس هذا النظام كإحدى أهم الآليات القانونية للتداول المستدام للنفايات الخطرة في مختلف النصوص القانونية. ولأجل ذلك أصبح من الضروري على كل مهتم بمزاولة نشاط الجمع والنقل، إضافة إلى المعالجة والتخلص من النفايات الخطرة، الحصول على ترخيص رسمي من الوزارة المكلفة بحماية البيئة، بهدف تحقيق أبعاد التداول المستدام للنفايات الخطرة، والمتمثلة في البعد البيئي الاقتصادي، الاجتماعي والتكنولوجي، مع التركيز على البعد البيئي الذي يعد كأولوية في الوقت الحاضر بالنظر لخطورة هذا الصنف من النفايات على البيئة وصحة الإنسان. Abstract: The licensing system is one of the legal and preventive measures taken by the Department in charge of Environment protection to ensure the prior control of how hazardous waste is traded and managed from the source of its production to disposal in an environmentally sound manner. Because of its own nature, its toxic and hazardous components; it requires constant and continuous caution when trading which makes the Algerian legislator devotes this system as one of the most important legal mechanisms for the sustainable circulation of hazardous waste in various legal texts. It is therefore necessary for all those interested in collecting and transporting activities, in addition to the treatment and disposal of hazardous wastes, they must obtain an official license from the Ministry of Environmental Protection, in order to achieve the dimensions of the sustainable circulation of hazardous wastes, namely the environmental, economic, social and technological dimension. Specially, the environmental dimension, which is considered a priority now considering the seriousness of this waste on the environment and human health.
