الطابع المزدوج لصلاحيات مجلس المنافسة في ضبط النشاط الاقتصادي

Résumé: تهدف هذه الدراسة إلى معرفة مضمون الصلاحيات الاستشارية و القمعية الممنوحة لمجلس المنافسة من أجل ضبط السوق و تقييد الممارسات المنافية للمنافسة فيه، بالإضافة إلى إدراك فعالية هذه الأخيرة في تحقيق التوازن للاقتصادي الوطني. لننتهي في الأخير إلى أن الآراء الاستشارية لمجلس المنافسة لا تلزم طالبيها بالأخذ أو عدم الأخذ بها ، فالالتزام يكون في طلب الاستشارة من عدمه ، مع تبيان سير عمل مجلس المنافسة عند ممارسته لصلاحية القمع الممنوحة له بدءا بالإخطار من المعنيين أو من تلقاء نفسه إلى فتح تحقيق للتأكد من صحة الادعاءات إلى صدور جزاءات في حقهم تكون مالية أو إدارية . The purpose of this study is to determine the content of the consultation and repressive powers given to the Competition Council in order to control the market and restrict anti-competitive practices, as well as the effectiveness of the latter in balancing the national economy. Finally, let us conclude that the consultation opinions of the Competition Council do not obliged applicants to take or not take it , so the obligation is in the request for consultation or not , while indicating the functioning of the Competition Council in the exercise of the power of repression granted to it, from notification by the persons concerned or on its own initiative to the opening of an investigation to ascertain the veracity of the allegations to the issuance of financial or administrative sanctions against them.
