Résumé: بموجب القانون العضوي رقم 22/13 المتعلق بالتنظيم القضائي راعى المشرع الجزائري المتغيرات الاقتصادية والاجتماعية، وكان ذلك سببا في تغيير قانون الإجراءات المدنية والإدارية بموجب القانون 13/22، والذي تبنى واستحدث محاكم متخصصة تختص بالفصل في بعض المنازعات ذات الطابع التجاري الخاص، وهذا وفقا لإجراءات تراعي خصوصية المنازعة التجارية. ولذلك جاءت هذه الورقة البحثية تنشد تفكيك المواد القانونية الناظمة للمحكمة التجارية لتبين بنيانها الهيكلي والبشري، وتحدد الكتلة الإجرائية الحاكمة لها مما يسمح بالوقوف على انعكاسها في توفير مناخ استثماري يسمح بجذب رؤوس الأموال الأجنبية بما يخدم التوجهات الجديدة للاقتصاد الجزائري التي تقف على التخلص من التبعية النفطية وتحقيق الاستثمار المستدام Under Organic Law No. 22/13 relating to judicial organization, the Algerian legislator took into account economic and social variables, and this was the reason for changing the Code of Civil and Administrative Procedures under Law No. 13/22, which adopted and created specialized courts specialized in adjudicating some disputes of a private commercial nature, and this is in accordance with procedures It takes into account the privacy of the commercial dispute. Therefore, this research paper seeks to dismantle the legal articles regulating the Commercial Court to reveal its structural and human structure, and to determine the procedural block governing it, which allows to determine its impact in providing an investment climate that allows attracting foreign capital in a way that serves the new directions of the Algerian economy, which stand on eliminating oil dependency and achieving...
