Résumé: أخرجت السياسة الجنائية المعاصرة العدالة الجنائية عن إطارها التقليدي، لترسم مفاهيم حولت من خلالها وظيفة الجزاء الجنائي، فجعلت الإصلاح العقابي يتقدم على وظيفتي الردع العام والعدالة، تسعى من خلاله إلى اقتلاع جذور الجريمة ومحاربة العود اليها ومجابهة ظاهرة اكتظاظ السجون الذي خلفته عقوبة الحبس قصير المدة، التي يحاول المشرع القضاء عليها من خلال تبني بدائل العقوبات. لذا أقر المشرع إجراءات جزائية جديدة من شأنها التقليل من عدد القضايا المعروضة على القضاء من جراء التضخم التشريعي، باستحداث أنظمة جديدة و التي أولت السياسة الجنائية من خلالها اهتمامها نحو المجني عليه، و تفعيل دوره في الخصومة الجنائية، و ذلك من خلال تنمية روح التصالح بين المتهم و المجني عليه. كما تبنت أيضا إجراءات تريد من خلالها تبسيط و تسريع وتيرة الإجراءات . Contemporary criminal policy has excluded criminal justice from its traditional framework, to draw concepts through which it has transformed the function of criminal punishment, and made penal reform take precedence over the functions of general deterrence and justice, through which it seeks to uproot the roots of crime, fight recurrence, and confront the phenomenon of overcrowding in prisons left by the penalty of short-term imprisonment, Which the legislator is trying to eliminate by adopting alternatives to penalties. Therefore, the legislator approved new penal procedures that would reduce the number of cases brought before the judiciary as a result of legislative inflation, by developing new regulations through which the criminal policy paid attention to the victim, and activating his role in the criminal litigation, by developing the spirit of reconciliation between The accused and the victim. It has also adopted procedures by which it wants to simplify and speed up procedures.
