الحماية الاجتماعية للطفل في خطر في ظل القانون 15-12 ـ بين النص والتطبيق ـ

Résumé: تهدف هذه الدراسة لإبراز الدور الذي تضطلع به الآليات الوطنية لحماية وترقية الطفولة ؛ في المنظومة القانونية التي تعنى بحماية الطفل المعرض للخطر،وسعيا منها لتحقيق المصلحة الفضلى للطفل عزز المشرع الجزائري القانون 15 ــ 12 المتعلق بحماية الطفل بمرسوم تنفيذي رقم 16 ــ 334 الذي يتضمن شروط وكيفيات تنظيم وسير الهيئة الوطنية لحماية وترقية الطفولة. حيث تتولى هذه الهيئة وضع نظام معلوماتي وطني حول وضعية الطفل في الجزائر، بالتنسيق مع مختلف الإدارات والهيئات المعنية، لاتخاذ أي تدبير من شأنه حماية الطفل في خطر عملا بالتقارير التي ترفعها إليها مصالح الوسط المفتوح. This study amis to highlight the role that the national mechanisms for the protection and promotion of childhood undertake in the legal system concerned with the protection of children at risk, and in order to achieve the best interests of the child, the algerian legislator strengthened law 15/12 related to child protection by and executive decree no 16/334 which includes terms and conditions of the organization and functioning of the National Authority for the protection and promotion of childhood. This body undertakes the development of a natoinal information system on the situation of children in Algeria , in coordination with the various concerned departments and bodies, to take any measure that would protect the child in danger pursuant to the reports submitted to by the services of the open-environment
