جريمة التعدي على الملكية العقارية بين النص والتطبيق القضائي The Crime Of Trespassing On Real Estate Property Between The Text And The Judicial Application

Résumé: تعتبر جريمة التعدي على الملكية العقارية ذات خصوصية كونها تجمع بين البُعد الجزائي والمدني بحكم طبيعتها. هذا التداخل طرح عدة إشكالات بخصوص شروط وأركان الجريمة أو فيما يتعلق بدور واختصاص القاضي الجزائي فيها، الأمر الذي أدى إلى توسيع اجتهاده في شأنها بما قد يبدو تجاوزا لمبدأ الشرعية إذا تمسكنا بالمفهوم التقليدي لذلك المفهوم. من أجل ذلك؛ نتعرض لجريمة التعدي على الملكية العقارية من خلال الإفراغ اللفظي للنصوص ذات الصلة ومناقشة تطبيقات المحاكم الجزائية في هذا الشأن والتي عكست توسعا ظاهرا في تطبيق النصوص بما قد يبدو أنه لا يتمشى أو يمس بمبدأ الشرعية، غير أن الدراسة العلمية سيما في ضوء التطورات الحديثة في علم التجريم والعقاب ستبين سلامة ما توصل إليه القضاء الجزائي في كثير مما ذهب إليه. Trespassing on real estate property is considered a crime with specificity, because it combines the civil and penal dimensions by its nature. This overlap raises a number of problems concerning the conditions and elements of the crime or the role and jurisdiction of the criminal judge therein, resulting in an expansion in the court’s jurisprudence thereon, which may seem to override the principle of legality if We adhere to the traditional meaning of this concept. Therefore, We deal with the crime of trespassing on real estate property through the verbal emptying of the relevant texts and the discussion of criminal courts applications in this regard, which reflects an apparent expansion in the application of the texts, which may appear to be inconsistent with or prejudice the principle of legality. However, the scientific study particularly in the light of recent developments in criminalization and penalization will demonstrate the correctness of many of the criminal courts’ findings.
