الأمن القانوني في التشريع الجزائري – قراءة على ضوء المادة 34 من التعديل الدستوري لسنة 2020)

Résumé: يعتبر الأمن القانوني من المبادئ الدستورية والقانونية المهمة، التي تسعى الدول والتشريعات لتحقيقها، لكن بالمقابل لا نجد نصوصا صريحة كثيرة له، ولهذه الأهمية نص التعديل الدستوري الأخير في الجزائر لسنة 2020 عليه في المادة 34، والذي يعد تطورا مهما وجديدا، هذه المداخلة تحاول معرفة الضوابط القانونية له. البحث توصل الى نسبية هذا التكريس، حيث يحتاج الى تنصيص قانوني صريح وواضح اضافة الى التنصيص الدستوري الموجود، كما أنه يعنى بمجال الحقوق والحريات دستوريا، ولا يشمل باقي القوانين حسب التفسير الضيق للنص. إضافة الى ملاحظات واقتراحات أخرى توصلنا اليها في هذا المقال. Legal security is an important constitutional and legal principle, which States and legislation seek to achieve. However, we do not find many explicit provisions for it. It is of this importance that Algeria's last constitutional amendment of 2020 provides for article 34, which is an important and new development. Research has reached the proportionality of this enshrinement, requiring explicit and clear legal provision in addition to the existing constitutional provision. It also deals only with rights and freedoms constitutionally, and does not include the rest of the laws according to the narrow interpretation of the text.
