الإثبات في جريمة تبييض الأموال في القانون الجزائري

Résumé: جاء القانون رقم 23-01 المعدل والمتمم للقانون رقم 05-01 المتعلق بالوقاية من تبييض الأموال وتمويل الإرهاب بتعديلات جوهرية، بهدف تفعيل وتدعيم القواعد القانونية الموجودة، لاسيما ما تعلق بالبحث والتحري عن هذه الجرائم وإثباتها. تهدف هذه الورقة العلمية إلى دراسة التعديلات المتعلقة بإثبات هذه الجرائم ومدى توفيق المشرّع من خلالها بين ضرورة مكافحة تبييض الأموال بالفعالية المطلوبة وضرورة احترام المبادئ الأساسية المكرّسة لحقوق الدفاع. لقد خلصت الدراسة إلى نتيجة مفادها بأنّ المشرع الجزائري لم يكرّس فكرة قلب عبء الإثبات في جريمة تبييض الأموال وإلقائه على المتهم بصفة صريحة، لكنه خلق نوع من اللّبس، من خلال النص على استقلالية هذه الجريمة عن الجريمة الأصلية، وإمكانية مصادرة أموال المتهم بغض النظر عن إدانته. Abstract: Law No. 23-01 amending and supplementing Law No. 05-01 relating to the prevention and fight against money laundering and terrorist financing made substantial modifications aimed at activating and strengthening existing rules, particularly in matters of proof. This article aims to study the modifications linked to the proof and the extent of the conciliation of the Algerian legislator between the need to fight effectively against money laundering and the imperative of respect for the principles rights of defense. The study came to the conclusion that the legislator did not explicitly enshrine the idea of reversing the burden of proof in this crime, but rather created a kind of ambiguity by establishing the independence of the offense of money laundering in relation to the main offense, and the possibility of confiscation of the accused's funds even in the absence of condemnation.
