ضمان حق الترشح ( دراسة مقارنة)

Résumé: ليس كل الأفراد المقيمين فوق إقليم دولة ما لهم الحق في الترشح للانتخابات، إذ أن هذا الحق مكفول للمواطنين دون الأجانب، أي الأفراد الذين يتمتعون بجنسية الدولة والمقيمون فوق إقليمها، وبالتالي المواطن لكي يصبح مرشحا يجب أن يكون أولا ناخبا، ثم بعد ذلك لابد أن تتوفر فيه مجموعة من الشروط، سواء كانت شروط موضوعية أم شروط شكلية، تنص عليها عادة الدساتير أو القوانين الانتخابية للدول، والتي قد تختلف من بلد إلى آخر. يلعب حق الترشح دورا مهما ومحوريا في العملية الانتخابية، إذ بدونه لا يتصور وجود انتخابات، فالمترشح والناخب هما الأساس في أي عملية انتخابية، سواء كانت محلية أم وطنية، فالمترشح هو الذي يمثل الهيئة الناخبة ويدافع عن حقوقها، ويظهر هذا الدور بصفة خاصة في الانتخابات النيابية سواء كانت محلية أو تشريعية. All individuals residing on the territory of a State do not have the right to stand as a candidate for election, because this right is guaranteed only for the citizens, and doesn't extend to the foreigners, which means for the individuals who have the nationality of the State and reside on its territory. Therefore, a citizen who want to be candidate for the election, he must first be a voter, then fulfills to a set of conditions, whether objective or formal conditions, generally provided by the constitutions and electoral laws of the States, which may vary from country to country. The right to stand for election plays an important and crucial role in the electoral process, because without it; there is no election. The candidate and the voter are the basis of any electoral process, whether local or national, the candidate represents the electorate body and defends their rights. This role is particularly evident in representative elections, whether local or legislative.
