الجوانب القانونية لحماية حقوق الإنسان في عرض البحر Legal Aspects Of Protecting Human Rights At Sea

Résumé: استقر العرف الدولي منذ الأزل على حكم يراعى فيه الجانب الإنساني للأشخاص المتواجدين في البحر من خلال واجب الإنقاذ البحري، وهو الحكم الذي يثبت قدم الترابط بين القانون الدولي للبحار الذي جاء لتنظيم حقوق والتزامات الدول على تلك المساحات البحرية، والقانون الدولي لحقوق الإنسان الذي يهدف إلى حماية الأفراد بغض النظر عن مكان تواجدهم. وبالرغم من قدم هذه العلاقة، إلا أن معرفة أي القانونين الواجب التطبيق على الانتهاكات الحديثة لحقوق الإنسان في عرض البحر، تبقى مسألة في غاية الصعوبة والتعقيد نظرا لاختلاف موضوعيهما وأشخاصهما، لذلك اتجه القضاء الدولي المعني نحو محاولة وضع الإطار القانوني لحماية حقوق الإنسان في البحر، من خلال تحديد الأساس القانوني لتلك الحماية، مع تحميل الدول المسؤولية بموجب الولاية القانونية التي تمارسها على الأشخاص، بالإضافة إلى حصر تلك الحقوق على اختلافها الأساسية والإجرائية التي يتمتع بها الأشخاص المتواجدين في البحر. International custom has been established since long time ago on a provision that takes into account the human side of the people at sea through the duty of maritime rescue, a provision that proves the interconnection between the international law of the seas that came to regulate the rights and obligations of states over these marine spaces, and international human rights law that aims to protect Individuals regardless of where they are. Despite this old relationship, knowing which two laws are applicable to modern human rights violations at sea remains a very difficult and complex issue due to the difference in their subjects and persons. Therefore, the concerned international judiciary has tended towards trying to establish the legal framework for the protection of human rights at sea, By defining the legal basis for that protection, while taking responsibility under the legal jurisdiction that they exercise over persons, in addition to restricting these rights to their different basic and procedural rights enjoyed by people at sea.
