في ماهية الترجمة القانونية- التكافؤ أنموذجا

Résumé: من خلال هذا البحث سنحاول أن نعالج بعض القضايا الجوهرية للترجمة و أن نسلط الضوء على الصعوبات التي تواجه المترجم المتخصص من خلال التطرق إلى الترجمة القانونية حيث سنركز على استراتيجية التكافؤ بمفهومها العام و القانوني بصفة خاصة ، وذلك بالتمعن أكثر في انواع التكافؤ بشكل عام و دراسة لأكثر نوعين متداولين في الترجمة القانونية ألا و هما التكافؤ الوظيفي و التكافؤ المعجمي و إمكانية تطبيقهما و مدى نجاعتهما من خلال جملة من التساؤلات، فما هو التكافؤ وما هي أنواعه ؟ وإلى أي مدى يمكن اعتماد استراتيجية التكافؤ في ترجمة النصوص القانونية ؟ وما هي أنواع التكافؤ الأكثر تحققا في الترجمة القانونية ؟ وما هي إسهامات و تجليات كل نوع منها ؟ In the present research, we will discuss the essencial issues of translation by shedding light on difficulties which face the specialized translator especialy in the legal translation . Moreover , in our researche we will focus on the equivalence strategy in general and on the legal concept in particular, by giving a deep sight at the common types of equivalence in the legal translation such as functional equivalent and lexical equivalent, and their applicability ,effectiveness throughout questions which are as follows : what means the equivalence in the legal translation ? what is the most effective equivalent in it ? and what are the contributions and aspects of each type ?
