القبول في التعاقد الإلكتروني

Résumé: الملخص: تهدف هذه الدراسة إلى معالجة كافة الجوانب المتعلقة بالقبول في التعاقد الإلكتروني، للوقوف على خصوصيته في إبرام العقد الإلكتروني، حيث تناولت مفهوم القبول ببيان خصائصه، وشروطه، وكذا طرق التعبير عنه إلكترونياً. كما ناقشت هذه الدراسة مسألة السكوت، ومدى اعتباره معبراً عن القبول في العقود الإلكترونية، وكذا حق الموجب له في العدول عن القبول الإلكتروني، والذي يُعد خروجاً عن قاعدة العقد شريعة المتعاقدين. Abstract : This study aims at exploring all the aspects related to “acceptance” in electronic contracting in order to look at its specificity in concluding the electronic contract. It deals with the notion of “acceptance” through showing its characteristics and conditions and also the ways of expressing it electronically. The study deals also with the question of “silence” and the extent to which we can consider it expressing “acceptance” in electronic contracts. It treats also the right of the offeree to backing down in the electronic acceptance which would be considered as breaking the principle “The Contract is the Law of Contractors”.
