Résumé: أصبحت الجزائر منذ1830 وجهة جديدة لموجات من الهجرة الأوروبية والفرنسية بدلا عن العالم الجديد ولتسهيل عملية توطين هؤلاء سعت الإدارة الاستعمارية إلى تنظيم المسألة العقارية وخلق فضاء عقاري يستوعب هذا الكمّ الهائل وفق ترسانة من التشريعات العقارية، خاصة في السنوات الأولى للاحتلال. وسوف نسلط الضوء على مدى خطورة النص القانوني الاستعماري في خدمة المشروع الاستيطاني الفرنسي في الجزائر من 1830-1873 باعتبار أن هذه المرحلة تعّد أخطر المراحل من تاريخ الوجود الاستعماري بالجزائر نظرا لحجم القوانين الصادرة من جهة ونتائجها الوخيمة على الفرد الجزائري من جهة أخرى. Since 1830, Algeria has become a new destination for waves of European and French migration instead of the new world, and to facilitate the settlement of these people, the colonial administration sought to regulate the real estate issue and create a real estate space that would accommodate this huge amount according to an arsenal of real estate legislation, especially in the early years of occupation. We will highlight the seriousness of the colonial legal text in the service of the French settlement project in Algeria from 1830-1873, as this is the most dangerous stage in the history of the colonial existence in Algeria, given the size of the laws issued on the one hand and their disastrous consequences on the Algerian individual on the other.
