الدفع بعدم الدستورية كألية بعدية للرقابة على دستورية القوانين

Résumé: يعتبر الدفع بعدم الدستورية آلية للرقابة البعدية على القوانين في المنظومات القانونية، هذا النموذج من الرقابة يعد من مستجدات التعديل الدستوري الجزائري لسنة 2016، في المادة 188 منه، ثم جاء أخر تعديل لدستور سنة 2020 أين تقدم المشرع بخطوة أخرى في هذا المجال وأنشأ هيئة قضائية سماها بالمحكمة الدستورية بما لها من صلاحيات قضائية تسهر على حماية الدستور وسمو أحكامه حيث منح للمتقاضين الحق في إثارة عدم دستورية نص تشريعي أو تنظيمي ينتهك الحقوق والحريات التي يكفلها الدستور، وذلك بمناسبة دعوى قضائية ينظر فيها، فيجوز للمتقاضي في التعديل الدستوري الجديد الطعن في النصوص القانونية المخالفة للدستور والتي سوف يتأثر بها حكمه وبالتالي تتأثر بها حقوقه وحرياته الدستورية، مما يعني أن للدفع بعدم دستورية القوانين أثر في حماية الحقوق والحريات العامة. The defense of unconstitutionality is considered a mechanism for post-monitoring of laws in legal systems. This form of censorship is one of the developments in the Algerian constitutional amendment of 2016, in Article 188 of it, then came the constitution of 2020, where the legislator established a judicial body called The Constitutional Court, that gives litigants the right to provoke the unconstitutionality of a legislative or regulatory text that violates rights and freedoms. In the new constitutional amendment, litigants may appeal against legal texts that are in conflict with the constitution, which means that “arguing for the unconstitutionality of laws” has an impact on protecting public rights and freedoms. Pending the issuance of the new organic law, the organic law 16-18 specifying the conditions and modalities for applying the unconstitutional defense will remain in force, which will be explained in this article.
