دور المحكمة الدستورية في مجال حل الخلافات بين السلطات الدستورية و تفسير الأحكام الدستورية

Résumé: أناط المؤسس الدستوري الجزائري في آخر تعديل له عام 2020 المحكمة الدستورية باختصاصي حل الخلافات بين السلطات الدستورية و كذا تفسير الأحكام الدستورية، و هو دور لم يكن مؤسسا من قبل في ظل تجربة العمل بالمجلس الدستوري؛ زيادة على ما يحوزه من أهمية بالغة في النظام الدستوري الجزائري في ظل ما أفرزته بعض التجارب السابقة من أزمات دستورية في هذا النطاق أثرت على السير الحسن للسلطات الدستورية . و تعرض هذه الدراسة الموجزة و المركزة قراءة قانونية لأهم الأحكام المنظمة لعمل المحكمة الدستورية ذات الصلة من خلال تحليل أهم النصوص و نقدها لكشف النقائص التي يمكن ان تساهم في تطوير هذه الخطوة الدستورية الهامة، و قد تم التوصل إلى تثمين هذا الدور الذي ينتظر ان تلعبه المحكمة رغم ما يكتنفه من غموض و نقائص في ظل غياب الممارسة العملية لهذا الدور إلى حد الآن. In addition to what it possesses of great importance in the Algerian constitutional system in light of what some previous experiences produced in terms of constitutional crises in this scope, which affected the good functioning of the constitutional authorities, This brief and focused study presents a legal reading of the most important provisions regulating the work of the relevant Constitutional Court through analyzing the most important texts and criticizing them to reveal the shortcomings that could contribute to the development of this important constitutional step. Despite its ambiguities and shortcomings, in the absence of any practice of role so far.
