حماية المستهلك في إطار العقد التوثيقي الالكتروني (دراسة مقارنة) Consumer Protection In The Frame Of Electronic Notarial Contract (comparative Study)

Résumé: يختلف العقد التوثيقي الالكتروني عن العقد التوثيقي المعروف والمحرر على دعامة ورقية، في أنه يحرر على دعامة الكترونية، لذلك فهو عقد رسمي يتمتع بنفس الخصائص التي يتمتع بها العقد التوثيقي الالكتروني، لا سيما خاصيتي القوة الثبوتية والقوة التنفيذية، ويعتمد في تحريره على الإجراءات الشكلية والقانونية المتعارف عليها، لكن باعتماد وسائل وبرامج الكترونية تسمح بالتواصل بين مكاتب التوثيق والإدارات المعنية، مع وجوب تلقي الإرادات من طرف الموثق سواء كان ذلك في العقد التوثيقي الالكتروني البسيط الذي يتم بحضور الأطراف، أو في العقد التوثيقي الالكتروني عن بعد، على وسائط الكترونية تحفظ السرية والسلامة، باتباع إجراءات وضوابط قانونية وتقنية يمكن من خلالها حماية المستهلك المتعاقد الكترونيا سواء في مواجهة الموثق محرر العقد باعتباره مهنيا محترفا يقدم خدمة عمومية، أوفي مواجهة الإدارات التي لها علاقة بالعقد التوثيقي بطريقة مباشرة أو غير مباشرة، أوفي مواجهة المتعاقد معه لاسيما إذا كانت له صفة المهني .Abstract: The electronic notarial contract differs than the known notarial contract in its electronic format. So that, the electronic notarial contract is an authentical contract has the same characteristics of the usual notarial contract. Especially in the probatory force, the executive power and it is relayed on the usual legal and formal procedures in its editing, except for the use of soft wares and electronics means that allow the communication between the notary and the administration. Besides that, the obligation of paying the notary either in the simple electronic notarial contract with the attending of the concerned parties, or in the electronic notarial contract from abroad, using electronic means that ensure the confidentiality and safety, by following legal and technical procedures and controls ,to protect the contracted consumer in facing either the notary; who drafted the contract as professional providing a public service, or, administrations that have direct or indirect relationship with the notarial contract, or, in facing the contracted with; especially if he has the status of professional.
