التجديد الفقهي

Résumé: ذكر الباحث بعض أوجه منهج التجديد، فذكر أن كل علم من العلوم يتحدد بمنهجه، ومنهجه يتحدد بموضوعه ومسائله، مع ضرورة التفرقة بين الشريعة من مصادرها من الكتاب والسنة، والفقه الذي هو اجتهادات المجتهدين، وأن التجديد الأصيل هو الذي ينبثق من داخل المنظومة الفقهية الإسلامية. كما تطرق الباحث إلى معرفة الواقع، فذكر أن موضوع الفقه هو أفعال المكلفين وهو السلوك الفردي والاجتماعي، وأشار إلى أهمية مقارنة المذاهب الإسلامية في الفقه، وأن المشكلات المتصلة بالأمة يكون الإفتاء فيها ضمن الاجتهاد الجماعي. The researcher mentioned some aspects of the method of renewal,he mentioned that each science is determined by its method which is determined by its subject and its issues, he also showed the difference between the Sharia based on Qur'an and Sunnah, and the jurisprudence whichrepresents scholars’ opinions. The article focuses on the importance of knowing the reality because the topic of jurisprudence is the actions of people. Finally he pointed to the importance of comparing the Islamic doctrines, and the reliance on collective jurisprudence to solve the nation’s problems.
