الجزاءات الإدارية ودورها في حماية المعطيات ذات الطابع الشخصي Administrative Sanctions And Their Role In Protecting Data Of A Personal Nature

Résumé: يتعين أن تتم معالجة المعطيات ذات الطابع الشخصي في إطار احترام الكرامة الانسانية والحياة الخاصة للمواطن والحقوق والحريات الاساسية، إذ لا يجوز أن تمس المعالجة بحقوق الأفراد وشرفهم وسمعتهم، لذا نص المشرع في القانون 18-07 على ضرورة الحصول على موافقة صريحة من قبل الشخص المعني، كما أنه تخضع كل معالجة للمعطيات ذات الطابع الشخصي لتصريح أو ترخيص تمنحه السلطة الوطنية لحماية المعطيات ذات الطابع الشخصي. إن مخالفة المسؤول عن المعالجة لأحكام القانون 18-07 ولاسيما الترخيص والتصريح أو عدم تبليغه واخطاره السلطة الوطنية بخصوص بعض الالتزامات لمنصوص عليها في القانون، يعرضه لعقوبات إدارية تصدرها السلطة الوطنية، قد تصل لحد سحب الترخيص نهائيا. Therefore, the legislator stipulated in Law 18-07 That the explicit consent of the person concerned should be obtained, Also, every data processing of a personal nature Is subject to an authorization or license granted by the National Authority to protect the data of a personal nature. Violation of the person responsible for processing the provisions of Law 18-18, especially licensing and authorization or not notifying him and notifying the National Authority regarding some of the obligations stipulated in the Law, exposing him to administrative penalties issued by the National Authority, may amount to a final withdrawal of the license
