التعويض عن العجز الكلي المؤقت الناتج عن حادث عمل Compensation For Temporary Total Disability Resulting From A Work Accident

Résumé: يهدف هذا البحث إلى معالجة إشكالية حوادث العمل وتبيين التعويضات التي يستفيد منها العامل أو من في حكمه إذا تعرض لحادث عمل نتج عنه عجز كلي مؤقت، وتبيين دور التعويض والمتمثل في إصلاح الضرر اللاحق بالمصاب. فإذا تعرض العامل أو من في حكمه، إلى حادث عمل سبب له عجزا كلي مؤقت عن العمل، يستفيد من تعويض جزافي مقدر قانونا تدفعه له هيئة الضمان الاجتماعي، وبمأنه تعويض مقرر بموجب تشريع خاص فإنه يقتصر على الإصابة البدنية فقط دون المادية، غير أن المشرع وسع من مفهوم حادث العمل حيث شمل ما يقع من حوادث أثناء العمل أو بمناسبته، كما وسع من قائمة المستفيدين من التعويض عن حوادث العمل. فيستفيد المصاب بحادث عمل من تعويضات في شكل أداءات عينية التي من شأنها أن تصلح الضرر الجسماني الذي أصاب العامل، وتعيد نشاط ووظيفة العضو المتضرر إلى الحالة التي كان عليها، ولو بالتقريب، كما يستفيد المصاب من أداءات نقدية مقدرة قانونا حسب مدة العجز الذي وقع له This search aims to address the problem of work accidents and to clarify the compensation from which the worker or his equivalent would benefit if he was exposed to a work accident that resulted in a temporary total disability, according to the descriptive and analytical approach, and to clarify the role of compensation, which is to repair the injury suffered by the injured. If the worker or those in his position are exposed to a work accident that causes him a total temporary disability to work, he shall benefit from a legally assessed penalty compensation paid to him by the Social Security Authority, and as it is a compensation determined under special legislation, it is limited to bodily injury only, but the legislator has expanded From the concept of work accident, as it included accidents that occurred during or in connection with work, and it also expanded the list of beneficiaries of compensation for work accidents. The injured person in a work accident benefits from compensation in the form of in-kind payments that would fix the physical damage that occurred to the worker, and restore the activity and function of the injured member to the state it was in, even roughly, and the injured also benefits from monetary payments legally estimated according to the period of disability that occurred to him.
