Résumé: According to Art. 12 of Law NO. 10-03, the investor on agricultural land belonging to State private property has the right to mortgage the right in kind resulting from concession with banks to finance their investments. Mortgage Debt must be paid within deadlines; otherwise, their land will beunder seizure, i.e. sold by public auction, which must take into account Procedures Law Provisions and the conditions mentioned in the second paragraph of Art. 12. It must be awarded to a natural person who is not excluded from concession right stipulated in Art. 07 and 19, andthe pattern of exploitation must be maintained
