إشكالية ترجمة مصطلحات الشريعة الإسلامية (القانون الإسلامي) من العربية إلى الفرنسية

Résumé: في هذا المقال، سنعالج إشكالية ترجمة المصطلحات القانونية الواردة في قانون الأسرة الجزائري والنابعة من الشريعة أو القانون الإسلامي من العربية إلى الفرنسية. هذه المصطلحات موجودة بالوثائق الرسمية التي تتمّ ترجمتها في مكاتب الترجمة المحلّفة والمعتمدة من طرف وزارة العدل الجزائرية. يتمثل الهدف من هذه الدراسة في البحث عن كيفية حلّ معالجة ترجمة المصطلحات القانونية التي لا نجد لها مقابلات في اللغة الهدف وما الإجراءات والتقنيات أو الاستراتيجيات الواجب تطبيقها للتغلّب على الصعوبات والعوائق التي تنجرّ عن عدم قابلية ترجمة هذه المصطلحات. يشكل هذا الطرح مشكلا مزدوجا، فمن جهة أولى، يطرح تساؤلات عامة حول منهجية الترجمة، وهي التساؤلات التي يجب على المترجم التكيّف معها، مع كونه مستقلا في نطاق تدخّله. ومن جهة أخرى، تقتضي هذه الفئة من الترجمات معرفة خاصة في المجال القانوني المتعلّق بالمؤسسات الإدارية والقضائية لبلد اللغة الأصل، وكذا معرفة تلك المؤسسات في بلدان اللغة الهدف. يواجه المترجم إذن عموما، بانتقاله من ثقافة قانونية إلى أخرى، عن طريق النص الأصلي، مشكلة عدم التكافؤ القانوني بين المصطلحات الواردة في النص الأصلي وكذا تلك الواردة في لغة النص الهدف. Through this article we address the problem of translating legal terms used in the Algerian family code, derived from Sharia or Islamic law, translated from Arabic into French. These terms are found in official documents that are translated in the sworn translation offices approved by the Algerian Ministry of Justice. The aim of this study is to search for a solution that enables the translation of legal terms for which we do not find correspondences in the target language, and what are the procedures, techniques, or strategies applied to overcome the difficulties and obstacles that result from the inability to translate these terms. This proposal tackles a double problem. On the one hand, it raises general questions about the methodology of translation, which are questions that the translator must adapt to, despite being independent in the scope of his/her intervention. On the other hand, this category of translations requires specific knowledge in the legal field related to the administrative and judicial institutions of the country of the source language, as well as knowledge of those institutions in the countries of the target language. Thus, the translator generally faces, by shifting from one legal culture to another, starting from the initial text, the problem of legal incompatibility between the terms used in the source text and those used in the target text language.
